"You're in the system." Said the woman at the crises center. "You've been assaulted before." 

The U.S. legal system is an ugly game easily bested by big dollars and corporate interests. Sorry to burst your bubble. 

You need only look at my complexion, skin, and hair to see that I've been fighting in court for two years. Only most can't see that: they expect that because I am a woman of color I would naturally show signs of degradation, wear and tear. But it isn't natural for me. 

The good news: it's temporary 

We fight so that other women will not have to tell this same story. And we will overcome. 
And oh how I wish Bella Caveat was operational right now.

Finally. I have long awaited this day. 

Not long from now, in a week or so, I will delete my personal Facebook account. And I have long awaited this day. At least from the time that I mentioned that I had been assaulted on New York Law School's campus by Stephen Nesbit in 2014, and Howard Meyers--lawyer, professor, and esteemed member of New York Law School--demanded that I remove all social media references to the assault, on behalf of New York Law School's Harassment and Discrimination Review Board, then comprised of Howard Meyers, Erika Wood, and Jeffery Becherer, all employees of New York Law School.

  • April 2016 Plaintiff filed suit in New York Supreme Court April 2016.
  • July 2016 Case was transferred to the S.D.N.Y. Federal Court, assigned to Judge E. Ramos.
  • December 2017 Court Order permitted plaintiff’s case to proceed
  • January 2018 Court issued a discovery schedule, plaintiff filed notice of intent to appeal the December Order, which dismissed parties and claims from the case.
  • March 2018 Plaintiff submitted first set of interrogatories and document production requests – discovery is actively ongoing (responses due by April 9, 2018)

  • January 2018 Plaintiff’s notice of appeal and record was sent to the Second Circuit and docketed
  • March 2018 Plaintiff is awaiting pre-trial conference records from the lower court
Why Now
The plaintiff’s health is an ongoing concern as a result of injuries stemming from this case. The defendants and their counsel have until now largely benefited from the plaintiff’s weakened state, which impacts her performance in this case. The plaintiff is now taking several steps to protect her ongoing interest in the case, including seeking representation willing to pursue a wrongful death action against New York Law School, Anthony Crowell, Deborah Archer, Barbara Graves-Poller, David Schoenbrod, Ella Mae Estrada, Jeffery Becherer, Howard Meyers, Erika Wood, Victoria Eastus, and Oral Hope if plaintiff does not survive. 

This is a plaintiff who has previously sought aid from and reported her injuries to the

  • Mayor de Blasio
  • New York Law School (the site where plaintiff was harmed)
  • The Board of Education's Office of Civil Rights
  • The Police Department 
  • The Manhattan DA's Office
  • The U.S. Attorney General's Office 
  • The Legal Grievance Committee (oversees lawyers' conduct)
  • The American Bar Association
  • Various attorneys 
  • The Southern District of New York's Pro Bono program 
  • Time's Up initiative's legal program (operated by the National Women's Law Center)

The plaintiff is a U.S. born military veteran, women of color, marathon runner, and dancer, who has never been in trouble with the law, but who is being treated less-than deserving of justice in order to grant unwarranted immunity to the defendants being sued--a law school and several attorneys and lawyers, and persons intricately involved in the wrong doing cited in her case.

The man who attacked her, Stephen Nesbit, and a male student (Jason Singer) who received favorable treatment worth thousands of dollars directly from Anthony Crowell (law school Dean), harmfully inserted himself and interfered in the investigation of the case at the law school. Both also must be held accountable for their acts.

As a country, we cannot afford to allow our moral values to be bought or influenced by status or any other figure of power. We cannot allow our outrage to be silenced or to mistakenly believe that a wrong committed against one woman will not have ripples.

​April will make two years since I filed a lawsuit against New York Law School. The lawsuit is ongoing (discovery is underway; interrogatories are due March 9). It’s difficult to sum up my feelings and experience in few words, but I can say that the U.S. justice system leaves much to be desired; it’s painful, mentally and physically exhausting, and reinforces what most American-born citizens who are not white understand: declaring yourself a beacon of civil and human rights does not make it so.
